Status: Not yet final
What happened
The European Commission found that Temu failed to diligently identify, analyse and assess the systemic risk of illegal products being sold to EU consumers on its marketplace. Its 2024 risk assessment relied on general information about e-commerce rather than evidence specific to Temu, understated how often consumers would meet illegal items, and did not assess how recommender systems and influencer programmes could spread them.
How it affected users
The Commission's mystery shopping found that many chargers tested failed basic safety tests and many baby toys posed medium to high risks from chemicals or small parts that can cause suffocation. It concluded that EU consumers were very likely to encounter illegal items on Temu.
Status timeline
May 28, 2026

PDD Holdings and Whaleco Technology reported to have appealed the fine (MLex; LexisNexis, 2026-08-19). No General Court case number found as of 2026-10-15, and both reports come from the same publisher, so this is recorded as not yet final until a filing is confirmed.
